1. Payment Facilitation Disclaimer

Nestiti acts solely as a technology platform facilitating payments between users, apartment associations, and third-party service providers.

We do not function as a bank, financial institution, or escrow service.

Key Points:

  • All payments are processed via third-party payment gateways
  • Nestiti does not hold or control user funds beyond technical processing
  • Transaction success depends on external payment systems

Examples:

  • If a payment fails due to bank/server issues → Nestiti is not responsible
  • If money is debited but not updated immediately → depends on gateway settlement

2. No Liability for Payment Failures

  • Failed transactions
  • Delayed payment confirmations
  • Duplicate transactions caused by user error
  • Bank or gateway-related issues

Users must resolve such issues directly with their bank or payment gateway provider.

3. Payment Verification Responsibility

  • Payment details
  • Recipient information
  • Amount before confirming the transaction

Examples:

  • Paying wrong apartment maintenance → user mistake, not refundable
  • Entering incorrect amount → Nestiti not liable

4. No Refund Obligation Beyond Policy

  • No refunds after 30 days of subscription
  • No refunds for completed or initiated services

Nestiti is not responsible for issuing refunds for:

  • Third-party service dissatisfaction
  • Delays or poor service quality

5. Third-Party Service Dispute Disclaimer

Any disputes arising between users and service providers must be resolved directly between the involved parties.

  • Nestiti is not a mediator or arbitrator
  • Does not guarantee service quality or outcomes
  • Is not liable for damages, losses, or disputes

Examples:

  • Cleaning service did poor work → take it up with provider
  • Plumber damaged property → Nestiti not liable

6. Platform Role Limitation

We do not control:

  • Pricing
  • Service execution

7. Chargebacks & Payment Reversals

If a user initiates a chargeback or payment reversal:

  • Nestiti reserves the right to:
    • Suspend the account
    • Recover outstanding dues
    • Take legal action if misuse is detected

Example:

  • User uses service → raises false chargeback → account suspension

8. Fraud & Misuse Clause

  • Investigate suspicious transactions
  • Block accounts involved in fraudulent activity
  • Share data with legal authorities if required

Fraud includes:

  • Fake payment claims
  • Unauthorized transaction disputes
  • Abuse of refund system

9. Limitation of Financial Liability

  • Indirect financial losses
  • Business losses
  • Loss of data or opportunity

Maximum liability (if any):
The subscription fee paid by the user. That’s it. Not more.
